1) RULING ON AQEEQAH. :-

There is a difference of scholarly opinion concerning the ruling on ‘aqeeqah, with there being three different views. Some say that it is obligatory, some said that it is mustahabb (recommended) and some say that it is Sunnah mu’akkadah (a confirmed Sunnah). The latter is the most correct view.

‘Aqeeqah refers to the animal sacrificed on the seventh day after birth as an act of thanksgiving to Allaah for the blessing of a child, whether male or female. It is Sunnah, because of the ahaadeeth that have been narrated concerning that. The person who does ‘aqeeqah for his child has to invite people to come and eat it, in his house or wherever, or he can distribute the meat raw or cooked to the poor and to his relatives, neighbours, friends, etc.

(FATAAWA AL-LAJNAH AL-DAA’IMAH, 11/442)

THE SCHOLARS OF THE STANDING COMMITTEE SAID : –

‘Aqeeqah is Sunnah mu’akkadah. For a boy two sheep which meet the conditions for sacrifice should be slaughtered, and for a girl one sheep. The sheep should be slaughtered on the seventh day, but if it is delayed it is permissible to slaughter them at any time, and there is no sin in delaying it, but it is better to do it as soon as possible.

(FATAAWA AL-LAJNAH AL-DAA’IMAH 11/439)

Narrated Salman bin ‘Amir Ad-Dabbi :

That the Messenger of Allah (p.b.u.h) said: “For a boy, there is an ‘Aqiqah. So spill blood for him and remove the harm from him.”

SUNAN TIRMIDHI (Vol. 3, Book 17, Hadith 1515)
SUNAN NASEEI (Vol. 5, Book 4, Hadith 4219)
ABU DAWOO (Book 15, Hadith 2833)

It was narrated from ‘Abdullah bin Buraidah, from his father, that:
the Messenger of Allah offered the ‘Aqiqah for Al-Hasan and Al-Husain. (Hasan)

SUNAN NASEEI (Vol. 5, Book 4, Hadith 4218)

2) BENEFITS OF AQEEQAH. :-

IBN AL-QAYYIM SAID :-

Among the benefits of ‘aqeeqah are .It is a sacrifice by means of which the child is brought close to Allaah soon after he comes into this world. It is a ransom for the newborn; his ‘aqeeqah ransoms him so that he can intercede for his parents. It is a sacrifice by which the newborn is ransomed just as Allaah ransomed Ismaa’eel with the ram.

3) THE BEST TIME FOR OFFERING THE ‘AQEEQAH IS ON SEVEN DAYS AFTER BIRTH. :-

It was narrated from Qatadah, from Al-Hasan, from Samurh bin Jundab that the Messenger of Allah said:”Every boy is in pledge for his ‘Aqiqah, so slaughter (the animal) for him on the seventh day, and shave his head, and a name” (Hasan)

SUNAN NASEEI (Vol. 5, Book 4, Hadith 4225)

Narrated Samurah:

That the Messenger of Allah (p.b.u.h) said: “The boy is mortgaged by his ‘Aqiqah; slaughtering should be done for him on the seventh day, he should be given a name, and his head should be shaved.”

SUNAN TIRMIDHI (Book 15, Hadith 34)
SUNAN TIRMIDHI (Book 15, Hadith 35)
ABU DAWOOD (Book 15, Hadith 2832)

It was reported that ‘Aa’ishah said: the Messenger of Allaah (peace and blessings of Allaah be upon him) did ‘aqeeqah for al-Hasan and al-Husayn on the seventh day, and gave them their names.

4) IT IS PRESCRIBED TO SLAUGHTER TWO SHEEP FOR A NEWBORN BOY AND ONE SHEEP FOR A GIRL. :-

It is prescribed to slaughter two sheep for a newborn boy and one sheep for a girl, as is indicated by the saheeh evidence, such as the following.

Narrated Umm Kurz:
That she asked the Messenger of Allah (p.b.u.h) about the ‘Aqiqah. He said: “For the boy is two sheep, and for the girl is one, it will not harm you if they (i.e. the sheep) are male or female.”

SUNAN TIRMIDHI (Vol. 3, Book 17, Hadith 1516)
SUNAN NASEEI (Vol. 5, Book 4, Hadith 4222)
SUNAN NASEEI (Vol. 5, Book 4, Hadith 4223)
ABU DAWOOD (Book 15, Hadith 2829)

It was narrated that Ibn ‘Abbas said:

“The Messenger of Allah offered an ‘Aqiqah for Al-Hasan and Al-Husain, may Allah be please with them, two rams for each.” (Sahih)

SUNAN NASEEI (Vol. 5, Book 4, Hadith 4224)

It was narrated from Um Kurz that the Messenger of Allah said:
“for a boy two sheep, Mukafaatan (of equal age), and for a girl, one sheep.” (Sahih)

SUNAN NASEEI (Vol. 5, Book 4, Hadith 4220)
SUNAN NASEEI (Vol. 5, Book 4, Hadith 4221)
ABU DAWOOD (Book 15, Hadith 2830)

5) DISTRIBUTION OF AQEEQAH MEAT. :-

It is permissible to eat from this ‘aqeeqah, and also to feed relatives, friends and the poor. It is permissible to cook it and then give it to others, or to give it to them raw.

It was reported that ‘Aa’ishah (may Allaah be pleased with her) said concerning the meat of the ‘aqeeqah: “It should be cut into pieces, then eaten and given to others.

(MUSANNAF ABI SHAYBAH 5)

It was narrated that Ibn Seereen and al-Hasan al-Basri said: “Among them the ‘aqeeqah was dealt with like a sacrifice; some would be eaten and some given to others.”

(MUSANNAF ABI SHAYBAH 5)

IBN HAZM SAID:-

“Some of the ‘aqeeqah should be eaten, and some given as gifts and in charity.”

(AL-MUHALLAA BY IBN HAZM 6)

It is mustahabb to cook all of the ‘aqeeqah, even the share that is to be given in charity, because it was narrated that some of the Salaf, such as Jaabir (may Allaah be pleased with him), regarded that as mustahabb.

Ataa’ ibn Abi Rabaah used to say concerning the ‘aqeeqah: “It should be cut into pieces, cooked with water and salt, and given as gifts to one’s neighbours.

SUNAN BAIHAQI (HADITH 19827)

6) DOES POOR ARE EXCUSED FROM AQEEQAH ? :-

There is no difference of opinion that it is not obligatory for one who is poor, let alone one who is in debt.

THE SCHOLARS OF THE STANDING COMMITTEE WERE ASKED : –

If I am blessed with a number of children, and I cannot do ‘aqeeqah for one of them because I am not well off, as I am an employee and my salary is limited and is only sufficient to cover my monthly expenses, what is the ruling on the ‘aqeeqahs of my children in Islam?

REPLIED :-

If the situation is as you described and you are not well off, and your income is only sufficient to cover your spending on yourself and those under your care, then there is nothing wrong with you not doing the ‘aqeeqah for your children, because Allaah says (interpretation of the meaning):

“Allaah burdens not a person beyond his scope”

(SURAH AL BAQARAH 2 VERSE 286)

“and [Allaah] has not laid upon you in religion any hardship”

(SURAH AL-HAJJ 22 VERSE 78)

“So keep your duty to Allaah and fear Him as much as you can”

(SURAH AL-TAGHAABUN 64 VERSE 16)

(FATAAWA AL-LAJNAH AL-DAA’IMAH, 11/436, 437)

7) IT IS PERMISSIBLE TO DELAY AQEEQAH ? :-

The Sunnah is Aqeeqah should be done on seventh day,but If it is delayed until after the seventh day, there is no sin, and it should be offered when the Muslim is able to do that.

THE SCHOLARS OF THE STANDING COMMITTEE WERE ASKED : –

A man had a number of sons and he did not do ‘aqeeqah for them, because he was poor. A few years later, Allaah made him independent of means by His Bounty. Does he have to do ‘aqeeqah?

REPLIED :-

If the situation is as described, then it is prescribed for him to do ‘aqeeqah for them, two sheep for each boy.

(FATAAWA AL-LAJNAH AL-DAA’IMAH, 11/441, 442)

SHAYKH IBN ‘UTHAYMEEN WAS ASKED : –

A man has a number of sons and daughters, and he did not do ‘aqeeqah for any of them, either because of ignorance or carelessness. Some of them are grown up now. What should he do now?

He replied: If he does ‘aqeeqah for them now, that will be good, if he was ignorant of the ruling or if he kept saying, “I will do ‘aqeeqah tomorrow” until too much time had gone by. But if he was poor at the time when ‘aqeeqah was prescribed, then he does not have to do anything.

(LIQA’ AL-BAAB AL-MAFTOOH, 2/17-18)

AL-LAYTH IBN SA‘D SAID :-

The ‘aqeeqah should be offered for the newborn on the seventh day; if they are not able to offer the ‘aqeeqah on the seventh day, there is nothing wrong with them doing so afterwards. It is not obligatory to offer the ‘aqeeqah for him after seven days.

(TUHFAT AL-MAWDOOD, PAGE 63)

IBN AL-QAYYIM SAID : –

If it is slaughtered on his behalf on the eighth or tenth day, or after that, it is acceptable.

(TUHFAT AL-MAWDOOD, PAGE 63)

Shaykh Saalih al-Fawzaan (may Allah preserve him) was asked: If I am in my city and Allah blessed me with a baby boy or girl, but I will not be able to go back to my husband in the other city where he lives until after a month or more, do I have to do the ‘aqeeqah on the seventh or fourteenth or twenty-first day as mentioned in the hadeeth of ‘Aa’ishah (may Allah be pleased with her), or is it permissible for me to delay it until I go back to my husband and do it when I am with him?

He replied: There is nothing to say that slaughtering of the ‘aqeeqah cannot be delayed until a time that is more suitable and easier for the parents or for one of them. Rather slaughtering it on the seventh day is recommended if that is possible. But if it is not possible then there is nothing wrong with delaying it until another time, according to what they are able to do. It should be noted that slaughtering the ‘aqeeqah should be done by the father of the child and it is one of the rights that the child has over his father.
